The Government has limited, until December 31, 2028, the acquisition of homes by entities referred to as "vulture funds," meaning persons with or without legal personality whose corporate purpose includes the buying and selling of real estate and who seek to purchase them for a price below 70% of their market appraisal value.

According to EFE, the 96‑page text was published this Wednesday in the BOE and is part of one of the two housing decrees approved the day before. According to Europa Press, the measure appears in Article 1 of the Royal Decree‑Law of urgent measures to protect the social function of housing and against speculation, and the exceptions had already been announced on Tuesday by the Housing Minister, Isabel Rodríguez.

The limitation will not apply when the transfer is intended for a primary residence at an affordable or social price for a minimum period of five years, or when the buyer is a person who requires social‑health care, a vulnerable group, or a victim of violence. It also will not apply if the purchasing legal entity demonstrates its adherence to a Code of Good Practices agreed with the competent housing authority.

According to EFE, holiday rentals with a stay of less than one month (30 nights) will have a specific tax regime with a 10% VAT. In the case of residential properties used for tourist accommodation, municipalities may impose an additional charge of up to 50% on the property tax (IBI).

According to EFE, the decree also incorporates measures to protect vulnerable people and those without housing alternatives from evictions until December 31, 2030, and allows tenants with current contracts until that same date to request an extraordinary extension of up to two additional years on an annual basis.

According to EFE, regarding short‑term rentals, the reason for the tenant’s temporary relocation must be stated and the contract duration will be agreed between the parties, being longer than 31 days and not exceeding 12 months.
